Terms and Conditions of Sale - Splat Products Ltd
Effective Date: 1 July 2025
1. Our Contract With You
1.1. These Terms and Conditions govern the supply of goods sold by Splat Products Ltd, a company registered in England and Wales (Company No. 09352124), with our registered office at Unit 3, Broombank Park, Sheepbridge, Chesterfield, S41 9RT ("we", "us", "our") to the customer ("you"). Our VAT registration number is 100406681.
1.2. All orders placed by you on our website are on the basis of these Terms and Conditions.
1.3. Your order constitutes an offer to us to buy a product. The processing of your payment and our acknowledgement of your order do not constitute legal acceptance. A binding contract between us is formed only when we dispatch the goods to you. We reserve the right to refuse any order prior to dispatch.
1.4. These Terms and Conditions constitute the entire and only agreement between us in relation thereto.
2. Pricing, Payment & International Orders
2.1. All prices shown on our website are in Pounds Sterling (£) and are inclusive of UK Value Added Tax (VAT) at the current rate.
2.2. For customers ordering from outside the United Kingdom, VAT will be removed at the checkout stage.
2.3. International Orders: For goods delivered outside the UK, you are solely responsible for any and all local import duties, taxes, and customs clearance fees. We are not responsible for these charges and cannot provide estimates for them. We recommend you contact your local customs office for further information before placing your order.
2.4. We do our best to ensure all prices are correct and up-to-date. In the event of a pricing error, we will contact you before dispatching your order to give you the option of reconfirming the order at the correct price or cancelling it. If we cannot contact you, we will treat the order as cancelled.
2.5. Payment for all goods and any applicable delivery charges must be made at the time of order.
3. Stock & Availability
3.1. We endeavour to maintain accurate stock levels on our website. However, stock availability is not guaranteed.
3.2. If there is a problem with the availability of a product you have ordered, we will contact you as soon as possible. You may then choose to cancel the order for a full refund or wait until the item becomes available.
4. Delivery
4.1. Delivery costs will be calculated and displayed at the checkout. Any delivery timescales quoted are estimates only.
4.2. We will deliver the goods to the address you specify in your order. It is your responsibility to ensure this address is accurate. We cannot accept responsibility for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions.
4.3. Risk in the goods will pass to you upon the completion of delivery, meaning the moment the goods come into your physical possession or the possession of a person identified by you to take possession of them.
5. Your Statutory Right to Cancel (Consumer Contracts Regulations 2013)
5.1. If you are a consumer, you have a legal right to cancel your contract with us for any reason within 14 days without giving any reason.
5.2. The cancellation period will expire 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
5.3. To exercise the right to cancel, you must inform us of your decision by a clear statement (e.g., a letter sent by post or an email). You can contact us at [email protected] or our postal address.
5.4. If you cancel this contract, you must send back the goods to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation. You will have to bear the direct cost of returning the goods.
5.5. We will provide a full refund, including the costs of initial delivery (except for supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). We may make a deduction from the refund for loss in value of any goods supplied if the loss is the result of unnecessary handling by you.
5.6. We will make the refund without undue delay, and not later than 14 days after the day we receive back from you any goods supplied.
6. Our 90-Day Extended Returns Policy
6.1. In addition to your statutory rights, we offer a goodwill returns policy. You may return any item to us for a full refund provided it is in a new, unused condition and in its original, undamaged packaging within 90 days of delivery.
6.2. To return an item under this policy, please contact us for instructions. You are responsible for the cost of return postage for items returned under this policy.
6.3. This policy does not apply to faulty goods, which are covered by your statutory rights (see section 7). Refunds on items returned after 90 days are subject to our discretion.
7. Faulty or Incorrectly Described Goods (Consumer Rights Act 2015)
7.1. Your statutory rights under the Consumer Rights Act 2015 state that goods must be as described, fit for purpose, and of satisfactory quality.
7.2. Short-Term Right to Reject (0-30 days): If your goods are faulty, you can reject them and claim a full refund within 30 days of receiving them.
7.3. Right to Repair or Replacement (after 30 days): If a fault is discovered after 30 days, you are entitled to a repair or replacement.
7.4. If you believe your item is faulty, please contact us immediately. We will cover the reasonable costs of return postage for goods that are confirmed to be faulty.
7.5. Your rights as detailed in this section are in addition to your right to cancel (Section 5).
8. Accuracy of Information
8.1. We invest significant time in describing and photographing our products. While we aim for 100% accuracy, mistakes can occur. If you have purchased something based on a picture or description on the website which turns out to be incorrect, we will be happy to replace the product or provide a full refund for the returned, unused item.
9. Intellectual Property
9.1. All pictures, material, code, descriptions, and other intellectual property on this website are the property of Splat Products Ltd. It may not be copied, used, or reproduced without our express written permission.
10. Limitation of Our Liability
10.1. Nothing in these Terms and Conditions shall limit or exclude our liability for: a) death or personal injury caused by our negligence; b) fraud or fraudulent misrepresentation; c) breach of your legal rights in relation to the products under the Consumer Rights Act 2015.
10.2. Subject to clause 10.1, we will not be liable for any losses related to any business of yours including (without limitation) lost data, lost profits, lost revenues or business interruption.
10.3. Our maximum liability to you for any loss or damage arising under or in connection with your order shall be limited to the total price of the products you purchased.
11. Data Protection
11.1. We will only use the personal information you provide to us as set out in our https://www.splatshop.co.uk/privacy-policy-cookie-restriction-mode.
12. General
12.1. Dispute Resolution: We aim to resolve any disputes quickly and efficiently. If you are unhappy, please contact us first. If we cannot resolve the issue, you may wish to use an Alternative Dispute Resolution provider.
12.2. Governing Law and Jurisdiction: This contract, and any dispute or claim arising out of it, shall be governed by and construed in accordance with the law of England and Wales. You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim.
